「性別工作平等法」第 18 條於 105 年 5 月 18 日業已修正為：「子女未滿二歲須受僱者親自哺（集）乳者，除規定之休息時間外，雇主應每日另給哺（集）乳時間六十分鐘。受僱者於每日正常工作時間以外之延長工作時間達一小時以上者，雇主應給予哺（集）乳時間三十分鐘。前二項哺（集）乳時間，視為工作時間。」；配合上揭哺乳時間規定之修正，原人事局 88 年 5 月 28 日 88 局考字第 011224 號書函、 91 年 8 月 16 日局考字第 09100296411 號書函、 92 年 3 月 21 日局考字第 0920006402 號書函及 93 年 5 月 3 日局考字第 09300117181 號函，均自 107 年 05 月 04 日起停止適用。
